Sport Toys USA, ("Distributor") warrants its products against all defects in materials and workmanship for a period of 120 days from the date of purchase subject only to the following conditions and exclusions:

1. Structural frame components including platform, steering components, electrical components, engine and internal components, frame and welds are warranted against manufacture defect only (not abuse) for 120 Days, to the original owner.
   
2. To present a claim, Customer shall deliver the defective part for exchange to Distrbutor, Selling Dealer or directly to an Sport Toys USA distribution center at his or her own expense.
   
3. This limited warranty is for the replacement or repair, at the option of Distributor's selling of defective parts only and does not cover any labor charges including, but not limited to, charges incurred for installation of replacement parts or additional fees which may be imposed by the dealer or service agent.
   
4. All warranty replacement parts are under warranty from the date of purchase of the original Products and not from the date of replacement.
   
5. The 120-day limited warranty covers the drivetrain (including the transaxle, motor and brake).
   
6. This limited warranty is valid and enforceable only on Products purchased in the United States and from a Sport Toys USA dealer. Items purchased outside the US must be sent back for repair at the expense of the purchaser. Purchaser must also pay for return shipping regardless of location.
   
7. This limited warranty is applicable only to the customer as an original purchaser of the Product(s) from a Sport Toys USA dealer and shall not apply to any subsequent purchaser, assignee or other recipient of the vehicle from the original customer.
   
8. No dealer or other similar person has any authority to make any warranties or representations concerning Sport Toys USA, or to extend thi warranty beyond the express terms contained herein. Distributor assumes no responsibility for any warranties beyond the express terms contained in this Limited Warranty. Customer releases and holds manufacturer harmless from any claims stemming from any unauthorized representations.
   
9. This warranty shall be void if the Customer modifies the Product in any respect including but not limited to the use of parts other than genuine Sport Toys USA parts.
   
10. This Limited Warranty applies only to Products purchased from Sport Toys USA or an authorized Sport Toys USA dealer.
    
11. This Limited Warranty does NOT include any and all labor charges incurred by the Customer to effect the removal and/or replacement of any warranted part(s) from the Product.
    
12. 120-day Limited Warranty Exceptions and Exclusions:
    
    1. Transaxle: In cases where there is an increase in the operational noise level this Limited Warranty shall not apply.
    2. Engine: If damage occurs to the engine as a result of not following the break-in procedure or due to insufficient engine oil and/or coolant, this Limited Warranty shall not apply.
    3. Brakes: 30-day Limited Warranty applies to manufacturing defects to the electrical or mechanical functioning of the brakes. Brake pads are a wear item and will NOT be warranted.
    4. Maintenance: Annual and normal maintenance schedules must be followed. Failure to properly maintain the Product shall void this Limited Warranty.
    5. Batteries: This Limited Warranty does not cover batteries, battery chargers or damage caused by battery leakage.
    6. Accessories: This Limited Warranty does not cover broken blinkers, mirrors, fenders, etc. except those broken in shipping.
    7. Upholstery: This Limited Warranty does not cover plastic shrouding or covers, seat upholstery, arm pads as these components are considered wear items, other than damage incurred during shipping.
    8. Parts damaged due to improper assembly, excessive force, or failure to follow reasonable mechanical standards are excluded from this Limited Warranty.
    9. Parts damaged due mishaps during shipping and/or handling.
13. All transportation costs and shipping damage incurred while submitting parts for repair or replacement are the responsibility of the original Purchaser.
    
14. This Limited Warranty does not apply to any injury, loss, defect or malfunction of the Product or failure to function resulting from any failure to operate or maintain Product in accordance with the directions contained in the Owner's Manual provided by Sport Toys USA or any injury, loss, damage, defect or malfunction, or failure to function resulting from any accident, acts of God, shipping damage, alterations in the Product by anyone other than the Distributor, or misuse, unreasonable use, tampering, abuse, acts, omissions, failure or negligence by anyone other than Manufacturer.
    
15. These warranties set forth herein are in lieu of any other warranties, expressed or implied, including the warranties of merchantability or fitness. Any such implied warranty imposed by state consumer law is limited in duration to 120 days from date of purchase.
    
16. Customer represents and agrees that any claims which it may assert against Distributor shall be limited to those which may be asserted under the foregoing limited warranty.
    
17. This warranty is offered exclusively by Sport Toys USA. By making a purchase with our company, Customer agrees that he/she has read, accepts, and agrees to this Limited Warranty and its terms.

How to file a warranty claim: First contact our tech support as most problems can be fixed with minor adjustments. If you find a part is defective you will need to remove the part and send it to us at your expense for exchange.

We are not responsible for shipping damage. Should your vehicle arrive with any damage, you must file a claim with the shipping company. We will assist you to the best of our ability in any claim process. We will not be responsible for additional shipping fees incurred due to inaccuracies in the address or phone number provided by you.

Sport Toys USA.com ships its 150cc and 250cc dune vehicles, mini sand rails, and go karts free of charge anywhere in the United States. However, our free shipping only covers transportation of your dune vehicle purchase(s) to the trucking company's terminal located nearest to your residence. Shipping to your home will incur additional delivery and lift-gate fees from the freight company. Call us for a quote and additional information.

You must call us to obtain a shipping quote. Shipping is billed as a separate additional charge from your vehicle purchase. Shipping to the freight company's terminal nearest your house and you taking delivery from there is the cheapest. Delivery directly to your home will cost more due to additional delivery and lift-gate fees from the freight company.

Parts are shipped to your door via DHL and are not covered by our free shipping policy.

Sport Toys USA.com will not share, sell, or otherwise intentionally distribute your personal and/or credit card information with/to any other person, business, organization, or other third-party entity.

It is the responsibility of the Purchaser, not the Distributor, to ascertain, and obey, all applicable local, state, federal and international laws in regard to the possession, and use, of any item purchased from Sport Toys USA. All equipment is sold subject to Public Law 90-351, Title III, U.S.D., Section 2511, and any local, state or federal ordinances or international law. Consult your local and state and country laws before ordering if you are in doubt.

Absolutely no sales to minors.

By placing an order, the buyer represents that the products ordered will be used in a lawful manner and that the he/she is of legal age. Sport Toys USA will not be held liable for the misuse of any product purchased from us or any of our distributors and dealers.

Also as no product is 100% effective against attack, Sport Toys USA assumes no responsibility if a product purchased from us is not effective in preventing bodily injury, dismemberment or death.

Should your item be confiscated by customs in your country you will NOT be refunded and you waive any rights you may have to deny your payment to us. Again, if you are in doubt check your local laws BEFORE purchasing a Product. This Product is not red or green sticker in California.

I, the Purchaser, being above age 18, agree to all terms as follows:

• I acknowledge and understand that driving motor sports are hazardous and dangerous activities that require strenuous exercise and various degrees of skill and experience for the different surfaces and venues. I understand that these activities can result in serious injury to the person and damage to property and voluntarily assume and any and all risks of loss, damage or injury while using these vehicles.
• I am aware of the risks, hazards and dangers of personal injury, death and disability inherent with any and all activities possible with use of this vehicle, as well as those inherent risks, hazards and dangers of personal injury, death and disability in participating in any motor sport event. I am aware that the usual risks, hazards and dangers of personal injury, death and disability increase when using inclines, or declines, bowls, jumps, hills or any other structure or device. I also understand that these risks, hazards and dangers are further increased when other persons, whether of the same level of experience or skill, are using the same vehicles.
• I hereby agree to release and forever discharge Sport Toys USA and its agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fees which are related to, arise out of, or are in any way connected to my participation or use of the vehicles, use of equipment or property supplied by Sport Toys USA or my presence upon the premises, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of the Seller listed above or the manufacturer or distributor.
• By this Agreement, it is my intention to surrender and waive any rights to sue or exercise any legal right to seek damages from Sport Toys USA and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf.
• This Agreement shall be effective and binding upon my heirs, agents, personal representatives and assigns.
• I hereby certify that I am over 18 years of age. I have carefully read the foregoing and acknowledge that I understand and agree to all of the above terms and conditions. I have had the opportunity to ask any and all questions regarding this agreement and the effect of the same. I am aware that by purchasing this Product and sending payment for it, I assume all risks and waive and release certain substantial rights that I may have or posses. I there for release all liability and waive any and all rights I may have in regards to my or my child's activities with the above item.
